WASHINGTON (AP) ? While the rest of us have to wait until June, the justices of the Supreme Court will know the likely outcome of the historic health care case by the time they go home this weekend.
After months of anticipation, thousands of pages of briefs and more than six hours of arguments, the justices will vote on the fate of President Barack Obama's health care overhaul in under an hour Friday morning. They will meet in a wood-paneled conference room on the court's main floor. No one else will be present.
In the weeks after this meeting, individual votes can change. Even who wins can change, as the justices read each other's draft opinions and dissents.
But Friday's vote, which each justice probably will record and many will keep for posterity, will be followed soon after by the assignment of a single justice to write a majority opinion, or in a case this complex, perhaps two or more justices to tackle different issues. That's where the hard work begins, with the clock ticking toward the end of the court's work in early summer.
The late William Rehnquist, who was chief justice for nearly 19 years, has written that the court's conference "is not a bull session in which off-the-cuff reactions are traded." Instead, he said, votes are cast, one by one in order of seniority.
The Friday conference also is not a debate, says Brian Fitzpatrick, a Vanderbilt University law professor who worked for Justice Antonin Scalia 10 years ago. There will be plenty of time for the back-and-forth in dueling opinions that could follow.
"There's not a whole lot of give and take at the conference. They say, 'This is how I'm going to vote' and give a few sentences," Fitzpatrick said.
It will be the first time the justices gather as a group to discuss the case. Even they do not always know what the others are thinking when they enter the conference room adjacent to Chief Justice John Roberts' office.
By custom, they shake hands. Then Roberts will take his seat at the head of a rectangular table. Scalia, the longest serving among them, will be at the other end. The other seven justices also sit according to seniority, the four most junior on one side across from the other three.
"They generally find out how the votes line up at the conference," said Orin Kerr, a George Washington University law professor who worked for Justice Anthony Kennedy nine years ago.
The uncertainty may be especially pronounced in this case, where the views of Roberts and Kennedy are likely to decide the outcome, Kerr said in an interview Thursday. "I don't think anyone knows. I'm not sure Justice Kennedy knows."
No one's vote counts more than the others', but because they speak in order of seniority, it will become clear fairly quickly what will become of the health care overhaul.
That's because Roberts speaks first, followed by Scalia, then Kennedy. If the three men hold a common view, the Obama health care overhaul probably is history. If they don't, it probably survives.
If Roberts is in the majority, he will assign the main opinion, and in a case of this importance, he may well write it himself, several former law clerks said. If Roberts is a dissenter, the senior justice in the majority assigns the opinion.
The court won't issue its ruling in a case until drafts of majority opinions and any dissents have circulated among the justices, changes have been suggested and either accepted or rejected.
"These justices aren't locked in. Minds have changed during the drafting process and minds have changed after opinions have been circulated," said Rick Garnett, associate dean and professor of law at Notre Dame Law School who worked for Rehnquist 15 years ago.
In one celebrated case decided in 1992, Rehnquist initially assigned Kennedy to write a majority opinion for five justices allowing prayers at public school graduations. In the end, Kennedy ended up writing the opinion for a different five-justice majority striking down the graduation prayers. According to several accounts, Kennedy simply changed his mind during the writing process.
No one will know precisely when decisions on particular cases will be coming, until perhaps Roberts ends a court session in late June by announcing the next meeting will be the last until October. Then it's a safe bet that whatever hasn't been decided will be on the last day. And decisions in the biggest cases very often aren't announced until that last day of the term.
Supreme Court opinions rarely find their way to the public before they are read in the marble courtroom, although the court inadvertently posted opinions and orders on its website about a half hour too soon in December.
The last apparent security breach occurred more than 30 years ago when Tim O'Brien, then a reporter for ABC News, informed viewers that the court planned to issue a particular opinion the following day. Chief Justice Warren Burger accused an employee in the printing shop of tipping O'Brien and had the employee transferred to a different job.
Sometimes, though, the justices themselves manage to let people know something big is coming.
On May 17, 1954, the attorney general, secretary of state and Nina Warren, wife of the chief justice, were in the courtroom when Earl Warren read the historic, unanimous opinion in Brown v. Board of Education outlawing school segregation.

Dell is getting out of the smartphone business in the United States -- wait, you mean you didn't know they were in it?
Let's put it this way: Dell entered the U.S. smartphone market quite late with the Aero (at left), launched in summer of 2010. Now, the company is getting out early, before spending more time and money on their poor-selling Android- and Windows-based devices. Dell's latest models, the Venue Pro (Windows) and Venue (Android) will not be sold any longer in the U.S. They will continue to be sold overseas.
"Mobility products typically have shorter lifecycles than laptops and desktops, and we have decided to no longer offer those two on Dell.com in the United States," said a Dell spokesperson in a statement to msnbc.com.
Jack Gold, principal analyst at J. Gold Associates, told?PCWorld?that Dell's move is probably a good one, and that it may allow the company to better focus on other products, such as tablets that use Windows 8, expected out this fall.
Android phones from Samsung, HTC and Motorola have done very well, and a Nielsen report Thursday says that?49.7 percent of U.S. mobile subscribers owned smartphones as of February, up from 36 percent a year ago.?Android-based phones lead the U.S. smartphone market with a 48 percent share, while Apple's iPhone is at 32 percent, and BlackBerry is at 11.6 percent.
Dell's smartphone appeal has not been domestic. The Texas-based company began selling phones first in countries like Brazil and China before the U.S.?
In the U.S. the company's 5-inch Streak smartphone and tablet did get some positive feedback, and Samsung has gone a similar size route with its Galaxy Note.
Dell's larger Streak tablet hasn't been on a selling streak -- especially compared to other offerings from Apple, Samsung and Amazon.com's Kindle Fire -- but with touch-oriented Windows 8, Dell may be able to better compete in the U.S. tablet market.
The company's decision doesn't preclude it from trying at smartphones again domestically.?"We're looking forward to offering new products and concentrating on expanding our growing mobility solutions portfolio in the future," Dell said in its statement.

Scientists at the Gladstone Institutes have discovered a key protein that regulates insulin resistancethe diminished ability of cells to respond to the action of insulin and which sets the stage for the development of the most common form of diabetes. This breakthrough points to a new way to potentially treat or forestall type 2 diabetes, a rapidly growing global health problem.
In a paper being published online this week in the Proceedings of the National Academy of Sciences, researchers in the laboratory of Gladstone Investigator Katerina Akassoglou, PhD, describe an unexpected role of the p75 neurotrophin receptor in controlling how the body processes sugar. Called p75NTR, this receptor protein is usually associated with functions in neurons.
"We identified that p75NTR is a unique player in glucose metabolism," said Dr. Akassoglou, who is also an associate professor of neurology at the University of California, San Francisco, with which Gladstone is affiliated. "Therapies targeted at p75NTR may represent a new therapeutic approach for diabetes."
The pancreas makes a hormone called insulin that processes glucose, moving it from the bloodstream into the body's cells where it is used for energy. Insulin resistance is a key feature of Type 2 diabetes, in which glucose builds up in the bloodstream and the body's cells are unable to function properly. According to the Centers for Disease Control and Prevention, more than 20 million Americans have type 2 diabetes.
"Type 2 diabetes has become a very serious health problem and it is increasing at an alarming rate," said Lennart Mucke, MD, who directs the institute in which the research was conducted. "These findings provide an important new avenue for developing better therapies to combat this deadly diseasethe seventh leading cause of death in the United States."
Complex signaling interactions between several different types of tissueincluding fat, liver, muscle and brainregulate glucose metabolism. Because p75NTR is found in fat and muscle tissue and participates in many important functions in the cell, Gladstone scientists hypothesized that p75NTR might also help to regulate glucose metabolism.
To study this, the researchers used mice that lacked the genes for p75NTR. They compared these mice to normal mice and discovered that those lacking p75NTR were more responsive to insulin when fed a normal diet. Second, they used some molecular biology tricks to block the action of the p75NTR protein in fat cells. This also resulted in increased glucose absorption in response to insulin. In contrast, when they caused the fat cells to make more p75NTR, glucose absorption was reduced. Additionally, the researchers found that another important regulatory molecule, Rab5, played a key role in p75NTR's impact on metabolism.
"Importantly, regulation by p75NTR enhanced insulin's effectiveness in normal lean mice on a normal diet," said Bernat Baeza-Raja, PhD, postdoctoral fellow and lead author of the study. "Because these mice already process glucose efficiently, the actions of p75NTR on glucose transport indicate a direct role of this protein in the regulation of glucose metabolism."
"Our studies of p75NTR's unanticipated role in regulating glucose metabolism suggest a new target for drug therapies," said Dr. Akassoglou. "Future work is needed to test whether this finding may translate into a potential treatment."

DUBAI, United Arab Emirates (AP) ? Kuwait is promoting the central bank's deputy governor to the institution's top job following the resignation of its long-serving leader last month, the finance minister announced Sunday.
The appointment of Mohammed Yusef al-Hashel as central bank governor comes as Kuwaiti labor groups, emboldened by Arab Spring protests elsewhere in the region, press for higher wages and perks from the country's rulers.
Mustafa al-Shimali, the Gulf nation's deputy prime minister and minister of finance, said the Cabinet approved al-Hashel's appointment, according to the official Kuwait News Agency.
Al-Hashel, 37, has served as deputy governor since 2009 and holds a doctorate in finance from Virginia's Old Dominion University, according to the bank's website.
He has been acting head of the bank since the resignation last month of Sheik Salem Abdulaziz Al-Sabah, a member of the country's ruling family, who led the bank for more than 25 years.
Sheik Salem quit in protest over a rapid rise in public spending, including substantial wage increases for oil workers and others.
Although the tiny nation ranks among OPEC's top oil exporters, the well-paying government jobs and a cradle-to-grave social security system that Kuwaitis have come to expect are increasingly becoming a burden on the state.
Even so, state workers are demanding more. Customs officials and employees of government-owned Kuwait Airways walked off the job earlier this month to demand higher pay, grounding dozens of flights and leaving some store shelves empty. They staged similar strikes last year.
Most Gulf Arab countries peg their currencies to the dollar. Kuwait, however, ties its dinar to a basket of currencies, a move designed to shield the economy from fluctuations in the dollar and give the central bank more monetary policy flexibility.
Sheik Salem's resignation was the latest in a series of departures by veteran policymakers who have quit as political tensions increased in recent months. The departures come in the wake of allegations of high-level corruption.
No formal charges were brought, but the political standoff over the graft claims eventually led to the resignation of the prime minister in November. That opened the way for parliamentary elections last month.
Opposition groups, including hard-line Islamists, won the majority of seats in the 50-member parliament, one of the few elected bodies in the region that can challenge policies and bring no-confidence motions against officials.

The Landmark Legal Foundation, a conservative legal group ran by radio host Mark Levin, called Tuesday for investigations into 29 Wisconsin judges who signed petitions to recall Republican Gov. Scott Walker.
?The public endorsement of Governor Walker?s recall warrants a full and immediate investigation into each of the 29 circuit court judges who reportedly signed the petition,? the complaint (PDF) to the Wisconsin Judicial Commission states.
Gannett Wisconsin Media reported on Saturday that the 29 judges ? 12 percent of the state?s approximately 250 judges ? had signed the recall petitions against Walker.
The Wisconsin Code of Judicial Conduct states that judges cannot ?participate in the affairs, caucuses, promotions, platforms, endorsements, conventions, or activities of a political party or of a candidate for partisan office.? However, it makes no explicit reference to recall petitions.
But according to Landmark?s complaint, signing the recall petition was tantamount to endorsing Walker?s opponents.
?The endorsement of sitting elected official?s removal by recall election is no different than the endorsement of a candidate for office. At a minimum, however, signing the recall petition gives the appearance of a political endorsement, which violates SCR 60.02 [requiring judges to preserve the independence of the judiciary].?
?The Commission should send a strong message to the Wisconsin judiciary that violating the Code of Judicial Conduct in this manner will not be tolerated,? the complaint concludes. ?Landmark respectfully requests that the full range of sanctions be considered for these egregious ethical violations including as appropriate reprimand, censure, suspension, and removal.?
When questioned by Gannett Wisconsin Media, Milwaukee County Judge Charles F. Kahn Jr said he signed the petition because he believed the people of Wisconsin should be allowed to vote again.
?I did not support any candidate and I did not support any political party,? he explained. ?This is a substantial and important distinction. I know that under the rules of judicial conduct ? which I take very seriously and follow totally and without question ? under these rules I?m not allowed to support a particular candidate.?

Each year, millions of monarch butterflies (Danaus plexippus) migrate from overwintering grounds in central Mexico to colonize eastern North America, but just how these delicate creatures manage to reach the northern part of their breeding range in spring has largely remained a mystery.
Monarch ButterflyNew research from the University of Guelph led by Prof. Ryan Norris, Department of Integrative Biology, former graduate student Nathan Miller and Environment Canada, reveals how monarchs recolonize the northern reaches of their breeding grounds ? information that will help preserve this migratory species threatened by loss of critical food and habitat.
Every year, adult monarchs head north to lay eggs on milkweed plants in the United States. Subsequent generations continue north to reproduce, some eventually reaching southern Canada.
But this amazing migration has been declared "threatened" by the International Union for the Conservation of Nature. Because of milkweed destruction, the monarch butterfly has remained on Canada's list of species of "special concern" since 1997.
Norris said scientists need to learn more about the butterfly's migration to forecast how it will respond to environmental change such as habitat loss.
"It wasn't clear where these individuals were born and how long they lived," he said. "One possibility was that some monarchs that reach places like southern Ontario could have migrated all the way from Mexico."
Miller sampled monarchs from 44 sites across Ontario and the northern states. By analyzing chemical markers called stable isotopes and examining wing wear, the researchers found that about 10 per cent reaching the northern breeding range in the spring come directly from Mexico.
"This is an incredible journey from an animal this size, especially if you consider that these butterflies are little more than eight months old and have travelled thousands of kilometres over their lifetime," Miller said.
Ninety per cent of monarchs sampled by the researchers in the spring were first-generation individuals born en route that year. Surprisingly, most of these monarchs were born in the highly productive region of the central United States, not in the southern states as previously thought.
"Linking these periods of the breeding cycle provides us key information for conservation and identifies highly productive regions that fuel the migration further north," said Norris.
The study appears in the journal PLoS One.

CHICAGO (AP) ? An artist admitted Friday to taking shortcuts in crafting an often harrowing tale about Apple Inc.'s operations in China after the veracity of his one-man theatrical show was challenged by a public radio program that had based a broadcast on his work.
But writer Mike Daisey said he stands by his monologue and called what he does theater, and not journalism.
"It uses a combination of fact, memoir, and dramatic license to tell its story, and I believe it does so with integrity," Daisey said in a statement posted on his website.
Citing what he called "numerous fabrications," Ira Glass, the host of the popular public radio show "This American Life," said he could not vouch for the truth of a Jan. 6 broadcast excerpted from Daisey's critically acclaimed one-man show "The Agony and the Ecstasy of Steve Jobs."
Later Friday, The New York Times said it had removed a questionable paragraph from the online archive of an op-ed piece Daisey wrote for the newspaper in October.
Daisey also twisted the truth about his time in China during an interview with The Associated Press late last year. Paul Colford, a spokesman for the news cooperative, said the AP was reviewing its coverage of Daisey to determine what corrections will be necessary.
In his monologue performance, which currently running at the Public Theater in New York, Daisey describes meeting very young workers who put in very long hours and were forced to do crippling, repetitive motions at factories that make Apple products in China. Some he claimed had been poisoned by a chemical called hexane.
But "This American Life" says a China correspondent for the public radio show "Marketplace" named Rob Schmitz located and interviewed Daisey's Chinese interpreter, who disputed much of the artist's claims.
Daisey, in an interview with Glass broadcast as part of Friday's episode of "The American Life," admitted that he didn't meet any poisoned workers and guessed at the ages of some of the workers he met.
"This American Life" said in its statement that staffers asked Daisey for his interpreter's contact information while fact-checking the story. Daisey replied the cellphone number he had for her didn't work anymore and he had no way to reach her.
"At that point, we should've killed the story," Glass said. "But other things Daisey told us about Apple's operations in China checked out, and we saw no reason to doubt him."
Apple has been rebutting Daisey's allegations for months, to little effect. The Times also wrote an investigative series in January on dangerous working and living conditions for people who make Apple products in China, including explosions inside factories making iPads where four people were killed and 77 were injured.
An Apple spokeswoman declined to comment Friday. Daisey spokesman Philip Rinaldi said Friday his client was "not speaking to anyone about this right now."
The original "This American Life" episode, "Mr. Daisey and the Apple Factory," has become the most popular podcast in the history of "This American Life" with nearly 890,000 downloads.
Daisey also claimed in an interview with AP late last year that he met Chinese workers whose joints in their hands had disintegrated because they were doing the same motion hundreds of thousands of times.
"I know that people in charge know about these things and chose not to address them. And that's hard to swallow when you see the damage it does and you know how little it would take to ameliorate a high degree of human suffering," he said then.
The Times, which published Daisey's op-ed piece following Steve Jobs' death in early October, removed a paragraph from the online version that discussed conditions at Apple's factory in China. The newspaper posted an editor's note warning readers that the section had been removed because "questions have been raised about the truth."
"The rest of the piece is his opinion as a performer and a thinker," said Eileen Murphy, a Times' spokeswoman. "If this were a news story it would be a different situation. It's not. It's an op-ed."
In his original monologue, Daisey splices Jobs career milestones and the transformation of Apple from a David into a Goliath with more personal stories about his own connection to the computer maker.
He has said that when he saw four photos posted online taken by workers at a Chinese factory to test the iPhone but mistakenly not erased, he suddenly realized people, not robots, were putting the sleek devices together.
In interviews and on stage, Daisey has said he traveled to the Chinese industrial zone of Shenzhen and interviewed hundreds of workers from Foxconn Technology Group, the world's largest electronics contract manufacturer, who suffered from their work.
"It's like carpal tunnel on a scale we can scarcely imagine," he said while performing the show in New York in October.
In this weekend's "This American Life," Daisey tells Glass he felt conflicted about presenting things that he knew weren't true. But he said he felt "trapped" and was afraid people would no longer care about the abuses at the factories if he didn't present things in a dramatic way.
"I'm not going to say that I didn't take a few shortcuts in my passion to be heard," he tells Glass.
Daisey has performed the monologue for some 50,000 people from Seattle to Washington, D.C., and it is now at The Public Theater until Sunday. Daisey was expected to take the show on tour, but its future is now in doubt.
In a statement, The Public Theater said the show would be performed in New York as scheduled and stood by what it called "a powerful work of art."
"Mike is an artist, not a journalist," the statement said. "Nevertheless, we wish he had been more precise with us and our audiences about what was and wasn't his personal experience in the piece."
